Specifically, you were offering hosted SmarterMail services, which certainly must have been in direct competition to your "core" customer. So this article sounds a little like the pot calling the kettle black.

Unfortunately, Microosoft's less-than-complete answer did not address IMAP. Further, this is only for Web edition, which we do not use at all for a variety of reasons.

Now that several months have gone by and the license managers have had sufficient time to field to digest the changes, and have likely fielded thousands of questions on the topic, and have done sufficient research-- I once again contacted both Insight and Microsoft directly.

And once again, the answer was the same. If the software on the machine is not YOUR intellectual property (such as is the case with SmarterMail and any other 3rd party app) and you are making it available for use by others, then you are an Outsourcer... and thus, subject to those obscene license fees.

http://tinyurl.com/y9jwew9 (HP) or http://tinyurl.com/yfdh5q7 (Insight)

Another option, at least for those of us who have been in SPLA for a while, is to avoid the issue by continuing to use Windows Server 2003 according to the older use rights. But, this option is NOT available to new SPLA members.

"If a Service Provider wants to continue with the pre-July 2009 Windows Server use rights, the Service Provider must:

• Continue offering their software service with that version of Windows Server.

• Continue to report the same stock-keeping units (SKUs) as prior to July 2009."
